These Travel Terms and Conditions apply to all tour and local arrangement services (hereinafter “the Tour Services”) provided by MANI TABI Co., Ltd. (hereinafter “the Company”) within the Kingdom of Thailand and neighboring countries. Please read carefully before making a booking.
1. Governing Laws and Terms
The Company is a tour operator and travel service provider based in the Kingdom of Thailand. The Japanese Travel Agency Act and the Standard General Conditions of Travel Agency Business in Japan do not apply.
All matters related to the Tour Services shall be governed and interpreted in accordance with the laws and commercial practices of the Kingdom of Thailand.
These Terms and Conditions, together with the specific conditions stated in each tour description, quotation, and invoice, constitute the contract between the Company and the customer (“the Customer”).
2. Passports, Visas, and Travel Requirements
As a general guideline, passports should be valid for at least six (6) months from the date of departure from Thailand, Japan, and any transit countries, and should contain at least two (2) blank visa pages. The Customer is responsible for confirming the latest requirements and making necessary arrangements.
Visa requirements, entry/exit regulations, vaccination and quarantine requirements, and other travel conditions are subject to frequent change. It is the Customer’s responsibility to confirm the latest information and complete all necessary procedures.
The Company assumes no responsibility and will not provide any refund for unused services in the event of denial of boarding, refusal of entry/exit, or any related issues arising from incomplete or incorrect travel documents or failure to meet official requirements.
3. Insurance and Safety Management
The Company maintains insurance in accordance with the laws of the Kingdom of Thailand; however, the scope and limits of coverage may be lower than typical standards in Japan.
The Company strongly recommends that Customers purchase comprehensive overseas travel insurance covering, including but not limited to, medical expenses, rescue expenses, and personal liability. The Company bears no responsibility for any loss or damage arising from the absence or inadequacy of such insurance.
The Customer is solely responsible for personal safety and risk management regarding pickpocketing, theft, fraud, traffic accidents, health issues, infectious diseases, natural disasters, and similar incidents.
4. Application, Contract Formation, and Payment
Tour prices are, in principle, denominated in Thai Baht (THB). Displayed prices and invoicing shall follow the exchange rate and conditions specified by the Company.
A contract is deemed concluded when the Company accepts the booking and confirms receipt of the required deposit or full payment, as specified.
Participants under 15 years of age must be accompanied by a parent or legal guardian.
For tours with specific purposes (such as inspections, training programs, or certain activities), the Company may refuse applications or participation if the Customer does not meet the participation conditions prescribed by the Company, including but not limited to gender, age, health condition, or required skills.
If the Customer has any pre-existing medical condition, is pregnant, has a disability, dietary restrictions, allergies, or requires special care, they must inform the Company in advance. Any additional arrangements or assistance are subject to availability and all related costs shall be borne by the Customer. The Company may not be able to accommodate all requests.
If payment is not confirmed by the specified due date, the booking may be treated as a cancellation made at the Customer’s convenience, and the applicable cancellation charges will be imposed.
5. Inclusions and Exclusions
Included in the Tour Price (subject to each specific tour description):
- Transportation, accommodation, entrance/experience fees, local staff/guide fees, taxes, and service charges as expressly stated in the itinerary.
Not Included in the Tour Price (examples):
- International air tickets to/from Japan, aviation taxes, and airport fees
- Excess baggage charges
- Transportation, meals, and personal expenses during free time (e.g. beverages, laundry, phone calls, massage, etc.)
- Tips (guideline may be provided; payment is at the Customer’s discretion unless otherwise specified)
- Medical expenses, testing fees, quarantine costs, and insurance premiums
- Transportation between the Customer’s residence and the meeting point, and between the disbanding point and subsequent accommodation, unless otherwise specified
No refund will be provided for any services included in the tour price that are not used due to the Customer’s personal circumstances.
6. Changes to the Contracted Services
The Company may, when unavoidable, change the itinerary, destinations, transportation, guides, or other services in the event of:
Natural disasters, deterioration of public safety, strikes, suspension or delay of transportation, road conditions, government orders, infectious disease situations, closure of facilities, or any other circumstances beyond the control of the Company.
In such cases, the Company will make reasonable efforts to arrange alternative services of a comparable level; however, the Company shall not be liable for any loss, mental distress, or loss of expected enjoyment arising from such changes.
If the Customer requests changes after the contract is formed, the Company will accommodate such requests to the extent possible. Any additional costs, cancellation charges, fare differences, and handling fees incurred as a result of such changes shall be borne entirely by the Customer.
7. Revision of Tour Price
If there is a significant change prior to departure in foreign exchange rates, fuel surcharges, taxes, public charges, or local supplier prices, the Company may revise the tour price accordingly.
If the Customer does not accept a price increase resulting from such revision, it will be treated as a cancellation made at the Customer’s convenience, and the applicable cancellation charges will apply.
8. Cancellation and Refund Policy
The “Cancellation Date” shall be the date and time when the Customer’s notice of cancellation is received and confirmed by the Company during its business days and business hours.
8-1. Tour Bookings (Shared or Private Tours)
- Before payment of the deposit: No cancellation fee
- After deposit payment up to 21 days before the tour date: 50% of the total tour price
- From 20 to 7 days before the tour date: 75% of the total tour price
- From 6 days before the tour date / no-show: 100% of the total tour price
8-2. Charter Vehicles (Taxi / Van etc.)
- Up to 3 days before the service date: No charge
- 2 days before the service date: 50% of the total amount
- The day before or on the service date / no-show: 100% of the total amount
Bank transfer fees, international remittance fees, and similar charges are non-refundable.
Changes to course content or dates may be treated as cancellation and new booking, and the above cancellation policy may apply.
9. Cancellation by the Company
The Company may cancel the contract in the following cases:
- When payment of the tour price is not received by the specified due date
- When it is found that the Customer does not meet the participation requirements (age, health condition, skill level, number of participants, etc.)
- When the Customer’s behavior is likely to cause significant trouble or danger to other participants or staff
- When the Customer repeatedly makes unreasonable or excessive demands beyond a reasonable scope
- When the minimum number of participants stipulated for the tour is not met (in such case, full refund of the paid tour price will be made)
- When, due to natural disasters, deterioration of public safety, infectious disease, government orders, suspension of transport services, or similar reasons, safe and smooth operation of the tour becomes impossible or highly likely to be impossible
In the event of cancellation for reasons attributable to the Company, the Company’s responsibility shall be limited to refunding the amount corresponding to the unprovided services. The Company shall not compensate for any incidental costs such as air tickets, accommodation, or transportation arranged by the Customer.
10. Termination During the Tour and Protective Measures
Even after the commencement of the tour, the Company may decide to suspend or terminate part or all of the services if any of the above circumstances arise, or if the Customer is deemed unable to continue participation due to serious illness, injury, or other reasons.
If the Company arranges protective measures (such as transportation to medical facilities or arranging alternative accommodation) in situations not caused by the Company’s willful misconduct or gross negligence, all actual and additional costs incurred shall be borne by the Customer.
No refund will be made for unused services in the event of voluntary withdrawal or interruption of participation by the Customer.
11. Liability and Exemptions
The Company shall be liable only when the Customer suffers damage as a direct result of the Company’s willful misconduct or gross negligence, and such liability shall be limited to direct and ordinary damages in accordance with the laws of the Kingdom of Thailand.
In any case, the maximum amount of compensation payable by the Company shall not exceed the total tour price actually paid by the relevant Customer to the Company.
For accidents or negligence related to transportation, accommodation, and other services arranged by the Company, the responsible party shall be the respective service provider in accordance with its own terms and conditions, and the Company shall not be liable beyond that scope.
The Company shall bear no responsibility for any damages arising from the following:
(1) Natural disasters, war, riots, terrorism, strikes, government orders, infectious diseases/epidemics, transportation disruptions, and similar events
(2) Suspension, delay, schedule changes, or alterations of services by transportation or accommodation providers
(3) Accidents or troubles occurring during free time or while the Customer is acting independently
(4) Food poisoning, excessive alcohol consumption, pre-existing medical conditions, or inadequate health management
(5) Theft, loss, fraud, assault, or other criminal acts
(6) Failure to participate due to late arrival at meeting points, failure to check notifications or emails, or communication issues
(7) Any damage arising from incorrect information, omission, or false declarations made by the Customer
12. Handling of Personal Information
The Company will collect and use personal information of Customers only to the extent necessary for travel arrangements, communication, insurance procedures, and safety management, and will handle such information appropriately in accordance with applicable laws and regulations.
